These Terms govern your use of Spark (“Service”), operated by ESNTL Systems (“we”, “us”). By creating an account at app.earnwithspark.com or using the Service, you agree to these Terms.
1. The Service
Spark provides AI-powered phone agents for inbound and outbound calling, including phone number provisioning, voice configuration, call handling, appointment booking features, and related dashboard tools. Features and included usage depend on your plan.
2. Your responsibilities
- You control your agent’s instructions, greetings, outbound lists, and voicemail scripts.
- You are responsible for complying with applicable laws, including call recording disclosure, telemarketing rules, TCPA, and Do-Not-Call requirements for outbound calling.
- You must obtain any consent required before calling or recording callers in your jurisdiction.
- You may not use Spark for fraud, harassment, illegal robocalling, or activities described in our Acceptable Use Policy.
3. Accounts & billing
Paid plans are billed through Stripe. Fees, included minutes, and line limits are shown at checkout and in your account. Unless required by law, fees are non-refundable. We may change plan pricing with reasonable notice.
4. Phone numbers & carrier rules
Phone lines are subject to carrier and registry requirements. Outbound caller ID may show as unknown or spam until registration completes. We may suspend lines that generate spam complaints or fraud flags.
5. Availability & changes
We strive for reliable service but do not guarantee uninterrupted operation. We may modify or discontinue features. Material changes to these Terms will be posted on this page.
6. Limitation of liability
To the maximum extent permitted by law, Spark is provided “as is.” We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost business from missed or misrouted calls.
7. Termination
You may cancel your subscription through account billing settings. We may suspend or terminate accounts that violate these Terms, law, or carrier policy.
